Creative Brain Challenge Official Rules

Who is eligible to participate in the challenge?
The Creative Brain Challenge is open to individuals who are 18 years or older, and is void where and to the extent prohibited by law and is subject to all applicable laws, including, without limitation, federal, state, and local laws and regulations. Employees of Posit Science Corporation and their family members, as well as other contractors working on behalf of Posit Science and other partners and affiliates, are not eligible to participate in the challenge. By participating, you agree to all the rules and decisions of Posit Science, which are final and binding, in all matters pertinent to the contest. No purchase is necessary to enter.

When does the challenge begin and end?
The challenge begins on July 14, 2008, and ends on August 31, 2008. All submissions must be received by Posit Science no later than 11:59 p.m. Pacific Time on August 31, 2008.

How do I enter the challenge?
Submit a creative work—a video, a photograph, painting or other picture, or a written piece—that connects the two challenge concepts: 1) the Mac and 2) the Posit Science Brain Fitness Program. Please read the official contest rules before entering.

How do I send my creative submission to Posit Science?

Videos: If you are sending a video, please email is at creativechallenge@positscience.com and let us know you plan on submitting a video. We will then instruct you on how to proceed.

All videos must not exceed two minutes in length.

Posit Science will accept videos in the following formats: WMV, MOV(Quicktime), MPEG, AVI

Photographs/Pictures: If you are sending a photograph or other picture, email your submission, as an attachment, to creativechallenge@positscience.com. In your email, include the following:

Your name
Your contact email address
Your contact phone number

All photos must not exceed 10 MB in file size.

Posit Science will accept the following graphics files: JPG, GIF, BMP, PNG

Written Pieces: If you are sending a written piece, email your submission, as an attachment, to creativechallenge@positscience.com.

In your email, include the following:

Your name
Your contact email address
Your contact phone number

All written pieces must not exceed 3,000 words in length.

Posit Science will accept the following document files: DOC, RTF, TXT, PDF

Electronic submissions are preferred, but if you would like to mail your piece to Posit Science, please send your package or envelope to this address:

Include a note that has your name, your contact phone number, and a contact email address (if available). Your creative piece must be received by Posit Science no later than August 31, 2008. Posit Science will not be responsible for lost or misdirected mail. Your submission(s) will not be returned.

Do I have to use the image files provided by Posit Science?
You are not required to use the images provided by Posit Science in your submission. We have made them available in case you want to use them to enhance your entry.

What happens to my submission(s) after the Challenge ends?
All submissions will become the property of Posit Science Corporation and may be featured on the Posit Science website (www.positscience.com) and/or Brain Fitness News, the Posit Science eNewsletter, or other Posit Science website properties. All submissions must be your original work and be created legally. Click here for more information.

Can I send in more than one submission?
You may send up to three submissions, but each individual who submits will be eligible to receive only one prize.

What prizes will be awarded?

First Prize: One MacBook Air pre-loaded with the Posit Science® Brain Fitness Program™ for Mac OS X with a two-person user license (approximate value: $2,300).

How will I know if I won?
Posit Science will review all submissions and select first, second, and third prize winners by September 15, 2008. Posit Science will notify the winners of the challenge by phone or email and post a list of winners at http://www.positscience.com/creativechallenge no later than October 1, 2008.

What if I have additional questions?

Creative Brain Challenge Official Rules

  1. The Creative Brain Challenge (“Challenge”) is sponsored by Posit Science Corporation (“Sponsor”) and is open to individuals who are 18 years of age or older. The Challenge is void where and to the extent prohibited by law and is subject to all applicable federal, state, and local laws and regulations.
  2. Employees of, and contractors to, Sponsor and its affiliates, partners, subsidiaries, advertising and production agencies, promotion and fulfillment houses, and their immediate families and household members are not eligible to participate in the Challenge.
  3. By submitting an entry, you agree to be bound by these Official Rules and to abide by all decisions of Sponsor, which are final and binding, in all matters pertaining to the Challenge.
  4. No purchase is necessary to enter the Challenge.
  5. An entry may be submitted in the form of a video (maximum: two minutes), a photograph, painting, or other picture (maximum:10 MB), or a written piece (maximum: 3,000 words) as detailed in the FAQ. Each entry should connect the two Challenge concepts, 1) the Mac and 2) the Posit Science® Brain Fitness Program™, in a creative manner. An individual may submit up to three entries. You may submit your entry online or via U.S. mail or other delivery service, as provided in the FAQ. Posit Science will not return any delivered submission.
  6. A panel of judges selected by Sponsor will judge submissions and select winners based on various criteria, including:
    • How well the entry incorporates two thematic elements: the Mac and the Brain Fitness Program;
    • Overall creativity;
    • Overall impact; and
    • Originality. The decision of the judges, in consultation with Sponsor, shall be final.
  7. Three prizes will be awarded to the winners: one First Prize - MacBook Air pre-loaded with the Posit Science® Brain Fitness Program™ for Mac OS X with a two-person user license (approximate value: $2,300); one Second Prize - $250 gift certificate for use at the Apple Store; one Third Prize - $100 gift certificate for use at the online iTunes store. Alternate prizes of equal or greater value may be substituted at the discretion of Sponsor. Each prize winner will be required to submit an affidavit of eligibility prior to the awarding of any prize, alternate winners may be selected if a required affidavit is not received by the applicable deadline, and no person may win more than one prize.
  8. By submitting an entry to the Challenge, you represent and warrant that: (a) your entry is your original work and was legally created by you; (b) your entry has not been previously published or distributed in any media in any country of the world; (c) your entry has not been previously entered in or won other contests or awards; (d) you have permission from any and all persons whose name, likeness, image or voice is used in your entry to use such name, likeness, image or voice; (e) you own all the rights to your entry; and (f) you will indemnify and hold harmless Sponsor, its subsidiaries, affiliates, advertising and production agencies, promotion firms, and all their respective officers, directors, employees, representatives and agents, from and against any and all claims and damages (including reasonable attorney’s fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, your entry, or your conduct in creating your entry.
  9. By submitting an entry to the Challenge, you agree that Sponsor and those involved in the development, production, implementation and distribution of the Challenge and their respective parent companies, affiliates, subsidiaries, services providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or the Challenge (each a “Released Party” and, collectively, the “Released Parties”) shall not be liable for any claims, damages, losses or injuries, including third-party claims, arising from or relating to, in whole or in part, the Challenge. Without limiting the generality of the forgoing, you waive any and all rights of publicity and privacy in connection with the use of your name, image and likeness by the Released Parties, and agree not to assert any claims against a Released Party for violation of a right of privacy or publicity, or for defamation, slander or any related claims in connection with the exercise of the rights granted by you herein.
  10. By submitting an entry, you acknowledge that Sponsor has no obligation to use or post any piece you submit. Sponsor shall not be liable for submissions that are delayed, lost, misdirected, illegible, incorrect or incomplete, and such submissions will not be eligible for the contest. Sponsor shall not be responsible for any technical malfunction of any computer on-line system, computer equipment or software, program malfunctions or other failures of any kind, whether human, mechanical or electronic, including, without limitation, any injury or damage to any computer used to submit an entry or any other person.
  11. By submitting an entry, you acknowledge that, if you win a prize, you will be responsible for any and all taxes related to such prize and, if the prize is to be shipped outside of the United States, international shipping costs for the prize including any applicable customs duties and/or brokerage fees.
  12. All submissions will become the property of Sponsor and may be used on Sponsor’s websites, in its newsletters or in such other manner as Sponsor deems fit in its sole discretion. By submitting an entry, you irrevocably grant Sponsor and its agents an exclusive, unlimited, worldwide, perpetual, unconditional, gratis license and right to publish, broadcast, reproduce, encode, store, copy, transmit, post, edit, modify, publicly display, publicly perform, adapt, exhibit, and/or otherwise use or reuse the entry, and your name, image and likeness, and the name, image and likeness of any and all individuals appearing in the entry, in any way, in any and all media or refrain from doing any of the forgoing, without limitation, notice, review, or approval from you or any other party.
  13. All entries must be received between 12:01 a.m. Pacific Time on July 14, 2008, and 11:59 p.m. Pacific time on August 31, 2008. To be eligible, an entry must be submitted online as provided in the FAQ. Entries submitted in an alternate manner or before or after the entry dates are not eligible for a prize.
  14. Winners will be notified by September 15, 2008, and must return a signed affidavit of eligibility within seven days of notification to receive a prize. A list of winners will be posted at http://www.positscience.com/creativechallenge on or before October 1, 2008.
